My blog diary of my fight against my son Richard's extradition to the US on allegations of copyright infringement for conduct which was not a crime in the UK. It transpires that extradition was sought because the US authorities were offended by Richard posting a rap video "F... tha Police" in protest at the seizure of his domain!

APPEAL LODGED 21ST MARCH 2012
An appeal was lodged against the District Judge Quentin Purdy's Ruling at Westminster Magistrates Court on 13th January 2012. The appeal is against Judge Purdy's decision on:

I am concerned about the recent case of Richard O'Dwyer, now threatened with extradition to the US for hosting a website with links to pirated material. While this is a crime in the US, apparently it is not in the UK. Theoretical case: if a US citizen hosted a web site in the US with links to pirated material from the UK, it would appear that the UK would have no grounds for an extradition request as no UK law has been breached. I was under the impression that one of the basic conditions for extradition to be considered is that the alleged crime be against the law in both countries.
when will you find out the decision of the appeal and what are your options if you loose the appeal?
ReplyDeleteWe don't have a date for the appeal yet, there are other appeals available. We want it sorted asap not hanging over our heads for years.

Yes that is true but we have little opportunity to prove its not a crime in the UK. The US protects its own citizens they wouldn't let this happen
